Patient Information Sharing Rules - CURES Act

The  Office of the National Coordinator for Health Information Technology (ONC) recently released a Final Update to the 21st Century CURES Act, which notably provides more detailed definitions and deadlines for updates that may affect Psychiatric practice. These rules will go into effect on April 5, 2021.

Definition for important terms such as "Electronic Health Information" and "protected health information" have been slightly changed, and it impacts the sharing or blocking of a patient's public records with that patient.

Below are some resources to help you learn the basics of these rules and what these terms mean. If you have questions about your practice, please contact your Risk Management provider or contact FPS if you are a member. If you are already using an EHI or EHR system, it also may be helpful to contact the company - but keep in mind that regardless of whether or not that company is required to comply, physicians that maintain EHI are.
