New Legislation: Non-Opioid Alternatives

Effective July 1, 2019, before providing anesthesia or prescribing, ordering, dispensing, or administering an opioid listed as a Schedule II controlled substance to treat pain, health care providers must now inform a patient about available non-opioid alternatives and provide the patient with a Department of Health educational pamphlet. TeleHealth 2020 Update: During
the 2020 Session, the Legislature passed HB 743 to address some of the
problems associated with HB 451 (2019) - the bill that established the
requirement for a non-opioid alternatives pamphlet for physicians
prescribing certain controlled drugs. The 2020 legislation amended the
requirements related to providing the printed non-opioid alternatives pamphlet to patients. Click here for information and to access the pamphlet. The
bill revises the requirements for certain health care practitioners who
provide an opioid drug listed as a Schedule II Controlled Substance.
These practitioners are required to inform the patient about possible
nonopioid alternatives, discuss the advantages and disadvantages of
nonopioid alternatives, and provide the pamphlet as required in section
